It is understood that by initiating inquiry / communication with Medical Treatments & Tourism India on website, you agree to get bound by ALL "Terms and Conditions of Services" of this agreement document of www.medicaltreatments.in . Medical Treatments & Tourism India reserves the rights to make changes in the "Terms and Conditions of Services" of this agreement.

Jurisdiction : You hereby agree that any kind of dispute arises by using this web site, the same be governed by the laws of state of Delhi, India without regard to its conflict of law provisions. You agree to personal jurisdiction in the state of Delhi, India.

Resolution of Conflict : If any medical discrepancy or conflict for immutability of malpractice occurs, the legal actions if carried out by the patient, all the concerned parties establish and agree that all judicial action must be carried out by the patient towards The Treating Institutions, Hospitals and/or Medical Professionals & Consultants only within the jurisdiction of the State of Delhi, India, and that action will not be extended towards www.medicaltreatments.in or it's managing company Medical Treatments & Tourism India or any of it's directors and employees since it is a company that puts at the disposition of the Participants / Patients to different professional options through listing their services without directly exercising / practicing, controlling or administrating medical sector professionally.

Indemnity : You agree to indemnify, Medical Treatments & Tourism India , it's directors, subsidiaries, affiliates, officers, agents and other partners and employees from any loss, liability, claim or demand, including reasonably attorney fees made by any third party due to or arising out of your use of the service in violation of this agreement and / or any breach of your representation and warranties set forth above.

Treating Institution, Hospitals, Medical Professionals & Consultants : Medical Treatments & Tourism India takes utmost care in preparation of the packages but has no direct control over, administration and operation of any Treating Institution, Hospitals, Medical Professionals & Consultants, etc. and neither does it control or operate any services, facilities provided by the Treating Institution, Hospitals mentioned in the packages or otherwise offered & confirmed (by service user)

The Treating Institutions, Hospitals and/or Medical Professionals & Consultants, shall be solely responsible for all treatments / medical services rendered by them to the Participants / Patient, including any surgical, medical, wellness, and all related queries, opinions and complications and Medical Treatments & Tourism India shall not be responsible for the same.

It is also agreed that Medical Treatments & Tourism India can not be made liable / responsible for any delay, default, failure, improper services / deficiency in services provided by the Treating Institution and/or for any injury, sickness, accident, discomfort, death, loss or damage of any kind whatsoever arising due to any act of negligence, deficiency or default in services, of the management or employees of the Treating Institutions, Hospitals and/or Medical Professionals & Consultants.

Emergency or complication : It is agreed that in case of development of any emergency or complication during treatment or any medical requirement, of whatsoever nature, arising with regard to the Participant / Patient's treatment due to the Participant/Patient's present or past illness or the side effects / allergy of / to drugs or lack of adequate treatment, pre, during or post treatment will be the absolute responsibility of the Treating Institutions, Hospitals and/or Medical Professionals & Consultants, as the case may be, and Medical Treatments & Tourism India shall not be responsible for the same.

Providing complete information before booking : The Participant / Patient or his / her family members / relatives / friends making the booking on behalf of the Participant / Patient does not mention or withhold any important medical information or other information which could effect the treatment & its results, Medical Treatments & Tourism India shall not be responsible the same. If because of negligence of Hospital management or treating doctor, important medical information is not asked, it will be the absolute responsibility of the Treating Institution and / or the treating Doctor, as the case may be, and Medical Treatments & Tourism India shall not be responsible for the same.

Medical Authority : If the Treating Institutions, Hospitals and/or Medical Professionals & Consultants is not competent in handling a particular emergency or complication arising pre, during or post treatment of the Participant / Patient, it shall be the absolute responsibility of the Treating Institutions, Hospitals and/or Medical Professionals & Consultants, as the case may be, to refer competent medical authority, after taking the consent of the Participant / Patient or his / her family members / relatives / friends and Medical Treatments & Tourism India shall not be responsible for the same.

Contingency Expenses of Treatment : It is agreed that though Medical Treatments & Tourism India informs & takes from the Participant / Patient, his / her or his / her family members / relatives / friends making the booking on behalf Participant / Patient, the approximate amount of the Treatment Package at the time of booking but the Participant / Patient, his / her or his / her family members / relatives / friends making the booking on behalf Participant / Patient shall confirm to pay all the possible Contingency Expenses (howsoever rare) that may arise as unforeseen / circumstantial or not included in the Treatment Package and Medical Treatments & Tourism India shall not be responsible for the same.

Contingency Expenses of Holiday Package : It is agreed that though Medical Treatments & Tourism India informs & takes from the Participant / Patient, his / her or his / her family members / relatives / friends making the booking on behalf Participant / Patient, the approximate amount of the Holiday Package at the time of booking but the Participant / Patient, his / her or his / her family members / relatives / friends making the booking on behalf Participant / Patient shall confirm to pay all the possible Contingency Expenses (howsoever rare) that may arise as unforeseen / circumstantial or not included in the Holiday Package and Medical Treatments & Tourism India shall not be responsible for the same.

Time & Treatment : The Treating Institutions, Hospitals and/or Medical Professionals & Consultants shall be for any diversions or extension or change in line of treatment, duration or treatment and dates of treatment, which may otherwise also arise due to certain unforeseen / unavoidable situation (as the case may be) and Medical Treatments & Tourism India shall not be responsible for the same.

Suggestion / Complaint : Any suggestion / complaint by the Participant / Patient (and his / her family members / relatives / escorts / friends making the booking on behalf of the Participant / Patient) in regard to the services / treatment provided by the Treating Institutions, Hospitals and/or Medical Professionals & Consultants, the same shall be forwarded directly to the concerned Treating Institutions, Hospitals and/or Medical Professionals & Consultants without any recourse to Medical Treatments & Tourism India

Agreement & Understanding of Terms & Conditions of Service : It is understood that all the Medical Treatments, Program, Service including Tours & Travels are all matter of serious planning and the Participant / Patient (and his / her family members / relatives / escorts / friends making the booking on behalf of the Participant / Patient) have thoroughly understood all the provisions / scope of the same, well in advance. Medical Treatments & Tourism India shall gladly provide all relevant available information on receiving your medical treatment enquiry complete in all respect with all relevant, necessary and vital information which may effect the treatment / service in any manner and if the Participant / Patient or his / her family members / relatives / escorts / friends making the booking on behalf of the Participant / Patient does not mention or with hold any important medical information or other information which could effect the treatment & its results, Medical Treatments & Tourism India shall not be responsible the same.
